Treason is the only crime that is explicitly defined in the United States Constitution.
“”Article 3 Section 3.
Treason against the United States, shall consist only in levying war against them, or in adhering to their enemies, giving them aid and comfort. No person shall be convicted of treason unless on the testimony of two witnesses to the same overt act, or on confession in open court.””
Any competent prosecutor should be able to demonstrate beyond a reasonable doubt that public declarations ruling out giving the Commander in Chief the necessary authority to defend this country against a specific enemy, certainly qualifies as providing aid and comfort to that enemy.
As far as the act being witnessed by two witnesses, thanks to the video, I think we have that requirement covered.
I see nothing in the Constitution where the first amendment protects anyone’s “right” to free speech includes providing aid and comfort.
