[su_right_ad]If florists and bakers are forced to provide services for gay weddings, the next thing you know, they’ll have to do bestiality weddings, reasons the preacher.

After a Washington state judge found on Wednesday that a Christian florist had violated the state’s anti-discrimination law by refusing to sell flower arrangements for a same-sex couple’s wedding, Robertson asserted that an “intelligent judge” would have ruled against the gay men.

“But this is outrageous!” the conservative preacher continued. “To tell a florist that she’s got to provide flowers for a particular kind of wedding. What if somebody wanted to marry his dog? She’s got to have flowers for that? What if there’s a polygamous situation where a guy has five wives and he wants to have five ceremonies, and she’s going to be forced by the law to provide them flowers. I mean, this is crazy.”[su_center_ad]

    Y’see, I have these dreams.
    Last night’s was a doozy.
    I dreamed it was late at night and I was walking down the street in Virginia Beach and found myself in front of Robertson’s house. There was a detour around about 150 feet of sidewalk in front of his lot because it had been ripped up and had the concrete repoured.
    Heh heh heh, it was just the right consistency for me to put my considerable artistic talents to work.
    I started off with some tasteful scenes of gays making out and got gradually more graphic with the scenes I scratched out. It was like an illustration of one of Caligula’s wilder parties, with animals, coprophilia – all kinds of things going on. Oh you should have seen my cross-hatching!
    My creation culminated in a beauty where the sidewalk from Robertson’s house intersected the sidewalk along the street.
    There I did a jolly scene from Tijuana that featured a donkey and a perfect likeness of Robertson himself (on the receiving end, natch!)

    Suppose that a Christian walks into a Muslim-owned bakery and asks for a cake decorated with a depiction of the prophet Mohammed. Suppose that a KKK member walks into a black-owned bakery and asks for a cake decorated with racial epithets. Suppose that a member of the Westboro Baptist Church walks into a gay-owned bakery and asks for a cake decorated with the message “God hates f*gs”.

    Aren’t there some circumstances where a baker can legitimately refuse to honor a request? If so, who gets to decide when the request crosses the line?

      Good questions.
      In your cases, they are asking the baker to create a cake advocating discrimination against the baker.

      For gays and other minorities that just want normal service…they are the ones being discriminated against.

      If a gay person wanted a christian to bake a cake making anti-christian epithets christians… it may be different.

      As to who gets to decide…I think it’s the courts under current anti-discrimination laws.

        At this point in time, how does an individual baker know where they stand, legally?

        Suppose that someone WANTS to cause trouble for a Muslim bakery owner. They go into the man’s bakery and order a cake to be decorated with a depiction of the prophet Mohammed. They actually WANT the owner to refuse so that they can sue him, thereby causing him to spend a lot of time and money defending himself. Their goal is to put him out of business.

        Imagine you are that Muslim bakery owner. The customer is standing in your shop. You need to make a decision. You say to the customer “I will happily sell you any product in my shop. I will happily create a cake for you and decorate it with any text or image you desire, with one exception. I refuse to create a cake with a depiction of the prophet Mohammed for any customer.”.

        In this case, the business owner’s policy is clear, but federal law seems murky. If, as you say, the courts get to decide, then the practical effect is that the Muslim baker doesn’t really have a right to refuse unless he has the time and money needed to defend himself in court.

        The Muslim bakery owner is not discriminating against particular people. Everyone is able to buy the same products at the same price. And nobody can order a “Mohammed cake”. So everyone who enters the shop is treated equally. The baker is refusing to create certain types of cakes, without regard to who is ordering the cakes.

        If a Muslim baker can refuse to make a Mohammed cake, why can’t a Christian baker refuse to create a cake depicting gay marriage? If the courts force the Christian baker to create the gay marriage cake, wouldn’t the courts also force the Muslim baker to create a Mohammed cake?

          Those are interesting hypotheticals, not real life events.

          People do refuse services.
          Then people are free to take their discrimination cases to court, and the courts decide.

            The supreme court routinely considers hypothetical situations when evaluating laws. A good law should stand up to scrutiny. It should works as well in special cases as it does in mainstream cases. Looking at hypothetical cases is how we avoid crafting laws that have unintended side-effects.

            If a group of engineers is designing a brake system for a car, you want them to consider as many hypothetical situations as possible. You want them to think about what would happen if the fuel line ruptured and sprayed gasoline directly onto the brake pads, even though it is not a common occurrence.

            We want our cars and our laws to be robust, meaning that they are designed to handle a wide variety of circumstances. We don’t want cars or laws that only work under laboratory conditions. We want cars and laws that work in the real world where things are messy.

            Is it really that hard to imagine Sean Hannity, Glenn Beck, or someone from Charlie Hebdo entering a Muslim bakery and ordering a Mohammed cake?

            The article that you linked contains this passage:

Lee, “When followers of a particular sect enter into commercial activity as a matter of choice, the limits they accept on their own conduct as a matter of conscience and faith are not to be superimposed on the statutory schemes which are binding on others in that activity.

            Do you interpret that to mean that the Muslim bakery is required to create a Mohammed cake?

    I agree, I am all for free speech. I completely disagree with granny’s point of view, but believe she has the right to object. I think reviews, word of mouth, etc. would spread about her political stance, and those who find her actions unacceptable will simply boycott her. I think voting with dollars is often more effective.
