An Iowa state Republican Lawmaker was arrested on charges of  sexual abuse, according to what Iowa Department of Public Safety officials reported on Friday. 78-year-old Henry Rayhons of Garner was  charged with third-degree sexual abuse.

Rayhons announced on Aug. 4th his withdrawal from the Iowa House race and cited family and health reasons.

According to WCCI, authorities said the Garner Police Department responded to the Concord Care Center on May 23rd on a report of sexual abuse involving one of the center’s residents.

The Garner Police Department sought the assistance of the Iowa Division of Criminal Investigation in the investigation.

Rayhons committed sexual abuse by performing a sex act on a woman suffering from mental defect or incapacity, after he had been told that the victim did not have the cognitive ability to give consent to any sexual activity, according to authorities.

Court documents show that “during an interview with a DCI agent on June 12th, 2014, the defendant admitted to having sexual contact with (victim) and to having a copy of the documentation regarding (victims) inability to give consent due to her lack of cognitive ability.”

The victim was identified as Rayhons’ wife, Donna Rayhons, who died just last week at 78-years-old.

Rayhons was arrested Friday and taken to jail.

The Hancock County Attorney’s Office has referred the case to the Iowa Attorney General’s Office for prosecution.

The Britt News Tribune reports:

In June, Suzan Brunes of Klemme, daughter of Donna Lou Rayhons, was appointed in court as her mother’s temporary guardian. Brunes’ application for guardianship stated Henry Rayhons had difficulty following parameters set by Concord Care staff.

Dale Rayhons, son of Henry Rayhons and family spokesman, said Friday morning in a prepared news release: “Accusing a spouse of a crime for continuing a relationship with his spouse in a nursing home seems to us to be incredibly illogical and unnatural, as well as incredibly hurtful.”
