A grand jury has handed up an indictment against Texas Gov. Rick Perry on two felony count for abuse of official capacity and coercion of a public servant late Friday by a Travis County grand jury in connection with the investigation into an effort to force Travis County District Attorney Rosemary Lehmberg to resign, Dallas News reports.

At the center of the indictment is a complaint regarding intimidation which stems from the Republican Governor’s  threat to veto of $7.5 million in state funding to the Public Integrity Unit which is run by Lehmberg’s office.

KXAN reports:

The threat came after she pleaded guilty to drunk driving and served a 45-day sentence; Perry called on her to step down but she refused to resign her position. Perry then vetoed the funding for the PIU.

A grand jury was called to determine whether or not Perry broke the law when he threatened to veto the funding. As a result they issued indictments on two felony charges: abuse of official capacity and coercion of public servant. If found guilty on the charges, Perry could be sentenced to a maximum 109 years in prison.

An indictment indicates the grand jury believes the state has a strong enough case to send to trial and is not a finding of guilt. Special prosecutor Michael McCrum oversaw the presentation to the grand jury who has been meeting on and off this summer and returned the indictment Friday afternoon.

Dallas News reports:

The grand jury was looking at potentially three state statutes: whether the longtime Republican governor tried to bribe a public official into stepping down; if he abused his position by misusing public funding “to obtain a benefit”; and whether he tried to coerce Lehmberg into taking “a specific performance of [her] official duty.”

Perry’s office has defended his actions, saying he exercised his constitutional authority to veto appropriations.

McCrum said, “The first count of abuse of official capacity. It basically charges that on the day of the veto in 2013 that Governor Perry intentionally or knowingly misused government property that had come into his custody or control.”

According to what McCrum told reporters, he plans to meet with Rick Perry’s attorneys on Monday.

      The time for it to have been tossed out was before it went to the grand jury. The grand jury weighed the evidence, and obviously, it found there was enough to hand down two indictments against Perry. Whether he gets convicted or not is another matter. That’s for the jury to decide.

If you actually take the time to read the details (you know, the whole story, not just what has been spoon fed to you) of the case, then switch the “D’s” and the “R’s” on the main players, anyone with common sense would see it for what it is, colossal waste of taxpayer dollars on political retribution.

          That’s not true, I have been following this story for quite awhile. Do some more research into the investigation of Rick Perry by Rosemary Lehmberg. Perry is corrupt and she was investigating him and that is why he tried to shut her down. He didn’t want to be exposed for corruption. This is more than just political. This is a governor trying to protect himself by shutting down the investigation into his own wrong doing.

    What could possibly be wrong with this case. Some say that a Grand Jury ruled in favor of the indictment. Did you know this the same county where the Grand Jury indicted Kay Bailey Hutchison, Tom Delay, La Christa Murray and all of them were overturned when the evidence couldn’t support the charges. There were others which you can check for yourself.
    Some don’t think this is motivated by politics when the evidence shows otherwise since this county is blue in a red sea, and because their high profile cases most always involve Republicans. And the now DA is a convicted drunk driver who spent time in jail and is the reason Perry used the veto power given to governors to prevent her from heading up a unit with the name Integrity in it. Not only was the DA drunk, her BAL was three times the legal limit and she became so combative that she had to be tied down. Another good reason for not wanting her to head a department where she would decide those cases to bring to the Grand Jury when her personal judgment shows it is lacking

        You bring up all unrelated stuff. It must be so busy in your mind that you randomly do a data dump regardless of the relevance.

        I don’t know you, but it is obvious that you are a strong supporter of liberal beliefs and vehemently opposed to conservative ones. Which is good because you’re not wishy washy about what you believe. However, you often use data from sites which reflect what you want the facts to say, but you routinely reject any data from other sites that conflict with the data you are happy with, even it there are a higher number sources disputing what you posted. It becomes a problem when you call a site unreliable, based purely on your own bias, especially when it is one that you used in the past because it reported what you wanted it to say.

        You give a liberal a pass for most anything they might do bad, but you fabricate things against conservatives for doing nothing more than having a different opinion with which you object.

        As for this subject, you are unable to separate your personal feelings for the Gov thereby missing what most other people have already concluded, this indictment smells really bad.

        I’m sure by now you’ve read comments from folks like David Axelrod and others on the left, but this one is more of the convincing statements made. “The charges are pretty obviously politically motivated, with even many liberals calling the charges bogus, including law professor Alan Dershowitz.

        Dershowitz, who is admittedly not a fan of Perry’s, nevertheless said he is “outraged” by the indictments. He said they are politically motivated, and a part of a “dangerous trend” of people using courts instead of the ballot box to effect political change.

        “Everybody, liberal or conservative, should stand against this indictment,” Dershowitz said. “If you don’t like how Rick Perry uses his office, don’t vote for him.”

    As Judge Saul Wachler famously said, a prosecutor could get a grand jury to indict a ham sandwich.
    Moreover, this is yet a another demonstration of the ineptness in American government. Offenses specific to government office holders are not normally covered in any criminal code; rather it falls within the purview of the respective legislative body to investigate and prosecute such offenses.
    Conversely, an office holder who violates a proscription of the criminal code, such as Ms Lehmberg, is clearly within the purview of the criminal justice system.
    You have a county district attorney, who obviously has a problem with alcohol consumption, convicted of a criminal offense; who is in charge of an integrity unit while demonstrating an incredible lack of integrity; who rebuffs a governor’s offer to allow her to exit with a modicum of dignity; and who lacks the integrity to exit of her own volition.
    Ms Lehmberg, having embarrassed herself, is willing to force the state to expend unnecessary funds to entertain these spurious charges, in an attempt to embarrass the governor, instead of seeking redress through the grievance process employees would normally take.
    Ms Lehmberg’s propensity to overindulge in alcohol consumption, her egregiously poor decision to drive while impaired and her willingness to subvert the system to avoid the full consequences of her bad behavior is testament to the fact that she is unfit to hold the office to which she is so desperately trying to cling.

It is hard for some who have invested themselves fully for a particular ideology to allow common sense to be applied to their understanding of a situation involving someone with a different ideology, even when it is clearly explained as you did so well.

          Is there anyone you can call to help you see that you have just proven “Always Right’s” point?
          The process you just described is exactly what I said the appropriate action is to address the allegations.
          Further, there is no reason for the governor to resign in that the state legislature has made no attempt to impeach him nor override his veto.
          In all likelihood it will be Lehmberg who, when faced with the reality of her situation, will resign. Like Al Gore she may realize that desperate acts of futility often adversely affect future endeavors.

        The legislature, not the governor, appropriates funds. The governor can veto if he disapproves and the legislature can override his veto.
