Count I Absolutely solid legal footing. I can’t see how Trump et al can even defend this… I’m certain they will try via motion to dismiss
Cont of Count I – the plaintiffs have clearly suffered grievous injury.
Count II Intentional Infliction, again plaintiffs solid footing
Count III absolute solid footing. Again the plaintiffs skillfully laid down the harm, statutes and actions of the defendants. Whomp!
Cont Count III & Prayer for relief Plaintiffs stated a bottom # of $75K seeking Compensatory & Punitive Damages. Jury WILL be sympathetic.
A few notable highlights:
Plaintiff Eric Schoenberg is described in the complaint as “a successful businessman who served as a Foreign Service Officer during the Reagan Administration. At different times, he has been registered to vote as a Republican and as a Democrat.”
Paragraphs 17, 18, and 19 detail the consequences for the plaintiffs when their identifying info, including Social Security numbers, were published on Wikileaks.
Paragraph 35 and 137-152: Read between the lines – they want discovery and deposition of Roger Stone above all other defendants. This could be an extinction-level disaster for the institutional GOP, for whom Stone has been a master of political dark arts.
Paragraph 79: This is big news – “The Government Communications Headquarters (GCHQ), a British intelligence agency, first became aware of suspicious interactions between members of the Trump Campaign and Russian intelligence operatives in late 2015. German, Estonian, and Polish agencies— among others—also detected such interactions between late 2015 and early 2016.” Will the GOP even dare to risk asking about this? It looks as if all of the hints we have been hearing from Malcolm Nance, Louise Mensch, and several other IC-connected pundits are right.
Paragraph 82: Confirmation that Sergei Rybakov is a “playa”.
Paragraph 83: There has only been passing mention of Konstantin Kilimnik in press coverage of Russiagate. Look for that to end fast.
Paragraph 85: Add Igor Sechin and Igor Diveykin to the scorecard. Wait – didn’t one of Sechin’s minions die under, well, suspicious circumstances? Carter Page has such nice friends!
Paragraph 100: As @SpicerLies pointed out, more Flynn cha-chingggg!
Paragraph 101: Lev Leviev’s name has already been bubbling under the Russiagate stew.
Paragraphs 160-161: Jared Kushner will do anything to keep from being deposed about this deal.
Stay tuned. This lawsuit has been under the mainstream media’s radar. If it gains traction, it won’t stay invisible for long.
UPDATE: At the Lawfare blog, Benjamin Wittes writes:
I think, in short, that this case is very likely to survive [a] motion to dismiss.
And that means the plaintiffs will get discovery. The pleading is rich—very rich and intentionally so, I suspect—with allegations that will provide for plausible discovery requests against all kinds of actors and on all kinds of subjects. It makes reference to the President’s tax returns, for example. It names a large number of individuals, whose depositions plaintiffs might plausibly seek. One of the defendants is the campaign itself, meaning that the campaign’s agents, actors, employees, and documents, are all potentially subject to discovery. So if I’m right that the suit eventually survives that initial motion to dismiss, it will immediately become a gold mine for journalists and investigators. And it will present an intense set of headaches for the Trump forces both inside and outside of government. Think Paula Jones, but not about a single act of alleged harassment. Think Paula Jones—only about everything.
So watch this one closely. It’ll be a sleeper for a while, but If I were the Trump forces, I’d be very worried about it.
